Terms of sale

1. Sales policy 

 

By placing an order via the e-shop, you declare that you have read and accepted these general conditions of sale before placing your order. Placing your order therefore constitutes acceptance of these general conditions of sale. Unless proven otherwise, the data recorded by the Company constitutes proof of all transactions carried out by the Company and customers.


The general conditions of sale are applicable to both the services and the products sold, with the exception of the product return conditions which are not applicable to the services.

These conditions may be subject to updates.

Orders can only be validly confirmed on the e-shop by an end consumer and provided that they act without commercial or resale intention. Resellers or individuals acting directly or indirectly on behalf of a reseller as well as agents and commission agents of resellers must contact the Company for all orders by e-mail to present their request.

2. Reservation of ownership


Until full payment of the price of the product ordered by the customer from the Company, ownership thereof remains in the hands of the Company. The transfer of risks of the product from the Company to the customer occurs upon receipt of the product by the customer at the address mentioned when ordering.

3. Products availability and pre order policy

 

We have limited stock of each of our products, but stock is indicated on each item.

 

The Company does not intend to sell the products offered in significant quantities. Consequently, it reserves the right to refuse orders (i) of the same product in large quantities and from 3 identical items, or (ii) in the event of a stock shortage. Furthermore, in the event that the product is unavailable after placing your order, we will inform you by e-mail. Your order will be automatically canceled and you will be immediately refunded if your bank account has been debited.


In the event of a stock shortage, you can either ask to be notified when a product will be back in stock, or place an order by contacting us directly: rose@roselinedoreye.com in which case the order must be approved for its validity; if conditions of sale, diverging from those provided herein, are determined between the parties on this occasion in writing (if applicable in electronic format) they will prevail over the provisions herein.

Furthermore, in the event of stock shortages, the Company may offer a pre-order policy in the future via its site. In this case, the customer's pre-order constitutes definitive placing of the order subject to the suspensive condition of the Company reaching a number of pre-orders from customers of the site for at least 10 units of the pre-ordered product with a view to its re-assortment (launch of the production of the units concerned). Payment is made upon pre-order, subject to immediate reimbursement to the customer in the event that the pre-ordered product has not been delivered to the customer's address mentioned in the pre-order after a period of 4 months from the date of placing the aforementioned pre-order.

4. Price 


The prices mentioned on the site may be modified at any time by the Company and without prior warning.


In addition to the prices mentioned on the site, the order also includes VAT to the exclusion of any other possible tax, customs fees and related costs (such as custody costs). These taxes and fees are therefore not mentioned in the order. Without prejudice to the above, transport costs are included in the order and indicated in the terms thereof; Transport costs are calculated according to the delivery address and the weight of your order.


If you have an intra-community VAT number, contact the Company (rose@roselinedoreye.com) to request a VAT-exempt invoice. Payment will then be made by transfer to our bank account.

The payment methods below are accepted:

*credit/debit card (Visa, MasterCard, American Express, ChinaUnionPay, Jcb, Diners, CB, Discover, Electron, Maestro) - payment is made securely on the site. *payment applications (apple pay, Google pay, Klarna, Paypal, Bancontact, IDeal, Alipay) - payment is assured and secured by financial partners, so no customer banking information passes through the site.

5. Shipping policy

 

The Company ships worldwide.

Unless otherwise indicated on the site, the products are delivered to the delivery address that the customer indicated during the order process, at the latest within 15 working days for the Benelux and France and for any address within another State of the European Union after a period of 30 working days. For any delivery address outside the European Union, delivery times may vary from 30 working days to 40 working days.


In the event of a delay due to any event (bad weather, accidents, etc.), not allowing the regular delivery of products, the Company cannot be held responsible for delivery delays.

The Company cannot be held responsible for any delivery failure due to an address declared as incomplete by the carrier. In the event of return of a package marked "incomplete address" or declared NATA (not at this address) by the transport company, we will issue a credit note for the customer's order upon its return to our premises. . The credit corresponds to the amount paid by the customer for the product ordered reduced by 20% to cover delivery costs and administrative processing costs. The credit can be used for any purchase in store or via the site's e-shop, it being understood that in the latter case the credit will be refunded upon payment of your new order.

6. Lack of conformity 

No later than 24 hours from delivery, you must notify the Company (by e-mail rose@roselinedoreye.com) of any lack of conformity of the products delivered, photos and other supporting evidence.

We undertake to reimburse you or exchange defective or damaged products. In this case, we kindly ask you to report this in detail in writing within 24 hours and to return the product(s) to us (return within 3 working days, the date of the postmark or that of a recognized carrier being taken as proof). We will, at your choice, exchange or refund the product(s). Return costs will be reimbursed to you based on supporting documents. 

Notwithstanding any provision to the contrary, any refund is subject to the condition of the return of the product(s) concerned, as stipulated above, accompanied by a copy of the purchase invoice for optimized management.

7. Right of withdrawal

 

The consumer has the right to notify the Company that they are renouncing the purchase, without penalties or indication of reason, within 14 calendar days from receipt of the package. If the right of withdrawal is exercised within the aforementioned period, the products concerned must be returned to the Company's address (return within 3 working days, the date of the postmark or that of a recognized carrier being taken as proof). Only the price of the product(s) purchased and shipping costs will be refunded; the return costs remain the customer's responsibility.

In accordance with current regulations, the right of withdrawal cannot be exercised for audio, video or computer software recordings unsealed by the customer.​

8. Personal data

  • When a customer places an order on the site, the Company collects personal information via the order form. This information is essential to the validation and delivery process of the ordered product(s).

  • Finalizing an order on the site requires the creation of a customer account in which personal information is protected by a password defined by the customer himself and not known to the Company. This information is purely confidential and is exclusively reserved for the Company and any authorized person/collaborator, deemed trustworthy and educated on the issue of processing personal data.

  • The customer has the right to see, modify, delete this data at any time by contacting the Company via the “contact” area of ​​the site or by post/email.

  • The site uses cookies to improve and personalize the customer experience. The purpose of cookies is to prove your visit and your preferences on the site.

9. Liability 

 

Applicable legal provisions govern the Company's liability for defective products.

 

The Company's liability is limited in any event to the value of the product purchased (transport costs not included).

 

10. Applicable law

 

The sale of products via the site is governed by Belgian law. ​

 

The application of the Vienna Convention on the International Sale of Goods (1980) is explicitly excluded.
